Scope of Agreement: These Terms and Conditions apply to all work performed by Putman & Sons Plumbing (PSP). The signed estimate, proposal, or invoice together with these Terms constitutes the entire agreement. Modifications must be in writing.
Authorization to Proceed Customer authorizes PSP to perform the work described and represents they have authority to approve the work.
Scope of Work Quoted pricing includes only the work specifically listed. Unless specifically stated, drywall, painting, flooring, tile, carpentry, concrete replacement, roofing, landscaping, electrical work, restoration, mold/asbestos remediation, and similar trades are excluded.
Hidden & Unforeseen Conditions If concealed conditions such as deteriorated piping, code violations, underground obstructions, rock, roots, asbestos, or other unforeseen conditions are encountered, additional labor and materials may be required. Whenever practical, PSP will provide a revised estimate before proceeding.
Excavation PSP is not responsible for damage to unknown or improperly marked underground utilities, sprinkler systems, invisible fences, septic systems, well lines, landscaping, concrete, asphalt, or similar items unless specifically included.
Permits & Inspections Permit and inspection fees are the responsibility of the Customer unless otherwise agreed in writing. Additional municipal requirements outside the original scope will be quoted separately.
Payment Terms Payment is due upon completion unless otherwise agreed. Late balances may accrue interest as permitted by law. Customer is responsible for reasonable collection costs and PSP reserves lien rights allowed under Michigan law. Customer in responsible to reasonable collection cost which includes all court costs and reasonable attorney fees
Change Orders Changes to the scope of work must be approved in writing.
Delays PSP is not responsible for delays caused by weather, shortages, inspections, permits, utility interruptions, or other events beyond its reasonable control.
Warranty One-year workmanship warranty unless otherwise specified. Manufacturer warranties apply to materials and fixtures.
Warranty Exclusions Warranty excludes misuse, neglect, freezing, foundation movement, customer-supplied materials, alterations by others, acts of God, and normal wear.
Drain Cleaning Drain cleaning restores flow but cannot guarantee future performance. Structural defects, roots, grease, or broken pipes are not covered. A stuck cable caused by existing pipe defects is the Customer’s responsibility.
Customer Responsibilities Provide safe access, secure pets, disclose known hazards, and maintain clear work areas.
Recommendations Declined If recommended repairs are declined, PSP is not responsible for failures resulting from those declined recommendations.
Warranty Claims Customer must notify PSP and allow PSP the first opportunity to inspect and repair warranty work before hiring another contractor.
Limitation of Liability PSP’s liability is limited to the amount paid for the applicable work, to the extent permitted by law.
Cancellation If work has begun or materials have been ordered, Customer agrees to pay for work performed and reasonable costs incurred.
Michigan Construction Lien Notice Insert attorney-approved Michigan lien language from the existing agreement.
Governing Law Michigan law governs this Agreement.
General Provisions Severability, entire agreement, and standard contract provisions apply.
